Delivery Terms

These Delivery Terms form part of the Agreement between SEQ SIA, a company incorporated under the laws of Latvia (the “Company”), and the Customer.
1. Nature of the Service
Breach is a fully digital service operated by SEQ SIA (Reg. 40203410806, Lastadijas 12 k-3, Riga, Latvia, LV-1050). No physical goods are manufactured, shipped, or delivered. All services are provided electronically through the platform at breach.offseq.com.
1.1 The Service is a fully digital, subscription-based cybersecurity monitoring platform delivered electronically via web dashboard and/or API access.
1.2 No physical goods are supplied.
1.3 Access to the Service constitutes digital content and/or digital services within the meaning of Directive (EU) 2019/770.
2. Activation and Delivery of Access
2.1 Delivery is deemed completed when Customer receives login credentials and/or API access keys and the Service becomes accessible through the online dashboard.
2.2 Activation typically occurs immediately upon successful payment confirmation.
2.3 In rare technical cases, activation may take up to 24 hours.
2.4 Confirmation of activation shall be provided via email and/or dashboard notification.
2.5 Access to the Breach dashboard and all features included in your subscription plan.
2.6 Ability to perform dark web searches, monitor domains and emails, and receive alerts.
3. Service Availability
3.1 The Company targets 99.9% monthly availability, excluding:
- Scheduled maintenance
- Emergency maintenance
- Force majeure events
- Internet or infrastructure disruptions outside Company control
3.2 Scheduled maintenance shall, where reasonably possible, be communicated at least 48 hours in advance.
3.3 Availability is measured on a calendar-month basis.
4. Data Retrieval
SEQ SIA does not store or host leaked databases on its own infrastructure. Breach intelligence data is retrieved in real-time from third-party intelligence providers via secure, encrypted API connections at the moment of your query.
Search results are temporarily cached to improve performance. Response times depend on the volume and complexity of the query but typically return within 2–10 seconds.
5. Delivery Timeline
All services are delivered instantly upon successful payment confirmation from our payment processor (EveryPay).
- Subscription activation: Immediate. Your plan features are activated within seconds of payment confirmation.
- Balance top-up: Immediate. Credits are added to your account balance as soon as the payment is confirmed.
- Record unlocks: Immediate. Unlocked data is displayed in real-time upon deduction from your credits or balance.
- Free trial: Immediate. A 14-day trial is activated upon account registration at no charge.
6. Service Level Commitments (SLA Framework)
The Company aims to maintain the following performance standards:
- Dashboard response time: typically under 10 seconds per query
- API response time: typically under 5 seconds per standard request
- Alert delivery: near real-time upon detection from available sources
6.1 These targets are performance objectives, not guaranteed outcomes.
6.2 For Business Customers, if monthly availability falls below 99%, Customer may request service credits within 14 days of the affected month.
6.3 Service credits are the sole and exclusive remedy for availability-related claims unless otherwise required by mandatory law.
7. Data Delivery Characteristics
7.1 The Service retrieves intelligence data from third-party and publicly available sources, including dark web monitoring channels.
7.2 Data may be cached temporarily to improve performance and updated dynamically as new information becomes available.
7.3 The Company does not guarantee:
- Detection of all breaches
- Completeness of third-party data
- Accuracy of information originating from external sources
7.4 All delivered intelligence is provided for informational and risk assessment purposes only.
8. System Requirements
The Service requires:
- Modern web browser (Chrome, Firefox, Safari, Edge — latest two versions)
- Active internet connection
- JavaScript enabled
API usage requires proper integration and authentication credentials issued by the Company.
9. Failed Delivery or Technical Errors
If access cannot be activated due to a technical fault attributable to the Company, the Company shall make reasonable efforts to resolve the issue promptly. If activation cannot be completed within a reasonable period, Customer may request either re-performance of activation or refund of fees paid for the affected period.
This clause does not apply where access failure results from: Customer system incompatibility, incorrect credentials usage, internet connectivity issues, or force majeure events.
If payment is confirmed but the service is not activated within 15 minutes due to a technical error, please contact us at breach@offseq.com. We will resolve the issue within 1 business day. If the service cannot be activated, a full refund will be issued.
10. Consumer Right of Withdrawal (EU Compliance)
If Customer qualifies as a consumer under applicable EU law, Consumers have a 14-day right of withdrawal from the date the contract is concluded.
By purchasing and activating the Service, Customer expressly requests immediate performance of digital services. Customer acknowledges that upon full activation of the Service, the right of withdrawal under Article 16(m) of Directive 2011/83/EU may be lost.
This waiver applies only to the extent legally permitted. Nothing in these Delivery Terms limits statutory rights that cannot be waived under applicable consumer protection laws.

11. Business Customer Specific Provisions
For Customers acting in a professional or commercial capacity:
- Statutory consumer withdrawal rights do not apply.
- Fees are non-refundable unless explicitly stated.
- Service activation and continued use constitute acceptance of delivery.
12. Incident and Outage Communication
In case of material service outage, the Company shall notify affected Customers via email or dashboard alert as soon as reasonably practicable. For critical outages, status updates will be provided periodically until resolution.
Support requests may be submitted via designated support channels listed on the website.
13. Export and Legal Restrictions
Delivery of cybersecurity intelligence may be subject to export control laws, sanctions regulations, and jurisdictional legal restrictions.
Customer agrees not to access or use the Service in violation of applicable export or sanctions laws.
14. Delivery of Updates and Improvements
The Company may update, enhance, or modify the Service. Updates that do not materially reduce core functionality shall not constitute non-delivery. Security updates may be implemented immediately where necessary to protect infrastructure or data.
15. Geographic Scope of Delivery
The Service is delivered electronically and accessible globally, subject to applicable legal restrictions, technical limitations, and sanctions compliance.
The Company may restrict access in certain jurisdictions where required by law.
16. Entire Delivery Agreement
These Delivery Terms operate together with:
- Terms of Service
- Data Processing Addendum
- Privacy Policy
In case of inconsistency, the Terms of Service shall prevail unless mandatory consumer law requires otherwise.
